At Clavio, Van Ordstrand & Associates, LLP, we represent family members who seek to establish guardianships over incapacitated persons and/or Minors. Incapacity is a terrible thing for a family and the incapacitated person to go through. It can strike quickly in the form of a stroke, illness or head trauma, or it can be a slow decline that sneaks up on everyone involved. Your loved one that becomes incapacitated will need someone to personal and financial affairs through an established Guardianship.
Minors on the other hand may require a Guardian if a child’s parents pass away or unable or unwilling to provide proper care and supervision for the child. This may be due to issues like drug addiction, mental illness, incarceration, or severe financial problems.
When a guardianship is necessary, our firm will handle all aspects of establishing and maintaining the Guardianship through the following:
- Petitioning the appropriate court for Guardian of the Person and/or Guardian of the Estate.
- Assisting with obtaining Physicians reports.
- Providing Notice to Interested Parties.
- Establishing the appropriate Surety bond when necessary.
- Obtaining Letters of Office naming the Guardian.
- Assisting with the annual reporting.
- General counsel throughout the process.

Living Trust

Pour Over Will
This is a will that pours over assets into your trust that have not been titled in the name of your trust during your lifetime (a "catch all" for loose ends). It also revokes any old wills you may have executed in the past and designates your wishes for a final resting place.
Power of Attorney for Property
This document appoints the individuals you choose to handle your non-trust assets and financial affairs on your behalf, should you become unable to do so yourself.
Living Will
This is the "right to die" document. It states that if you are terminally ill, your health care agent may terminate artificial life support or death delaying procedures.

HIPPA Release and Authorization
HIPAA release document allows healthcare providers to release health information and/or medical records to your health care representative.
Asset Transfers
Our office will handle the transfer of your assets into the name of the trust. This includes creating and recording new Deed for your property and moving bank / investment accounts.
